The Medicare Modernization Act requires that all Part D plan sponsors have a comprehensive fraud, waste and abuse program in place. This includes pharmacies having to certify that their employees have completed fraud training and are familiar with the pharmacy's fraud, waste and abuse policies. This training must be done annually.

To assist pharmacies in Florida we are bringing to you a product that can be customized by you to show evidence that you are in compliant with your Part D plan sponsors. This FWAM is written in Word format and can be revised with your company logo and contact information.

The FPA has included a section in this manual to help pharmacies comply with the requirements for managing fraudulent prescriptions. House bill 7095 passed by the 2011 Florida legislature and signed into law by Governor Rick Scott requires pharmacy permits to have as a general requirement under 465.022 a set of procedures for the dispensing of controlled substances to minimize dispensing based on fraudulent representations or invalid practitioner-patient relationships. Pharmacists must also report to the local sheriffs office or law enforcement agency within 24 hours or the next business day efforts by individuals to obtain controlled substances by fraudulent means. We have included in this manual tools and a sample set of procedures and support tools to assist pharmacists and pharmacies with compliance.  There is also a change to Florida rules for pharmacists on the requirement to validate controlled substance prescriptions which is included in this manual.
